These Terms of Service (“Terms”) govern your access to and use of the Cityscribe application for iOS and iPadOS (the “App”), cityscribe.com, and related services (together, the “Services”). They form an agreement between you and Cityscribe (“Cityscribe,” “we,” “us,” or “our”).
By creating an account or using the Services after being given notice of these Terms and an opportunity to review them, you agree to these Terms. If you do not agree, do not use the Services. Our contact information appears in Section 18.
1. ELIGIBILITY
You must be at least 13 years old and meet any higher minimum age or other eligibility requirements that apply where you live. If you are not legally able to enter into these Terms yourself, you may use the Services only if applicable law permits it and your parent or legal guardian has reviewed and agreed to these Terms on your behalf. Regional App Store ratings and access restrictions may also apply; they do not replace legal requirements concerning eligibility or parental authorization.
If you use the Services for an organization, you represent that you have authority to agree to these Terms on its behalf. You may not use the Services where doing so is prohibited by applicable law.
2. CHANGES TO THE SERVICES OR THESE TERMS
We may change the Services or these Terms to introduce or improve features, address security or abuse, reflect changes in technology or third-party services, or comply with legal requirements.
For changes that materially affect your rights or obligations, we will provide clear notice and reasonable advance notice where appropriate, such as through the App or an account email. Updating the date on this page alone will not be our only notice of a material change. Urgent changes necessary for security, safety, or legal compliance may take effect sooner, with notice when reasonably possible.
Changes apply prospectively. We will obtain additional agreement where required by law. We will not treat a general update to these Terms as permission to expand rights in content you previously submitted without any additional agreement required for that change. If you disagree with revised Terms, you may stop using the Services and request account deletion. Continued use after appropriate notice and the effective date constitutes acceptance only to the extent permitted by applicable law.
If we discontinue the Services or materially reduce their main functionality, we will provide reasonable advance notice where practicable and honor any applicable rights to retrieve content, terminate, or receive another remedy.
3. YOUR ACCOUNT AND SECURITY
An account is required for certain features, including creating lists, saving content, following other users, and submitting photos. You must provide accurate account information and keep information needed to contact or authenticate you up to date.
Protect your credentials and use the available security settings appropriately. Do not impersonate another person, use someone else’s account without permission, or allow your account to be used to evade restrictions. Contact support@cityscribe.com promptly if you suspect unauthorized access.
You are responsible for your own conduct and activity you authorize through your account. These Terms do not make you automatically responsible for every unauthorized use regardless of fault, or reduce our obligations to protect the Services.
4. USING CITYSCRIBE
Cityscribe helps you discover places, organize places into lists, add notes, mark places as visited, follow other users, view public content, and submit place photos. Some features provide recommendations based on saved places or other relevant context. Features and availability can vary by location, device, app version, and service provider.
Subject to these Terms, you may access the Services for their intended purposes. Cityscribe and its licensors retain rights in the App, service design, software, branding, and content other than User Content you own. These Terms do not give you ownership of those materials or permission to redistribute third-party place information or images beyond the rights made available through the Services or applicable law. Your software license for the App is addressed in Section 12.
5. PLACE INFORMATION AND THIRD-PARTY SERVICES
Place information, maps, ratings, photos, and related material may come from other users and providers such as Apple, Foursquare, Tripadvisor, and Unsplash. Information can be incomplete, inaccurate, outdated, or unavailable. A listing or recommendation does not guarantee a place’s quality, safety, accessibility, opening hours, or availability, and does not imply endorsement by Cityscribe.
Use your judgment and confirm details directly with a place when they matter to your plans. Cityscribe is not an emergency service and should not be relied on for emergency assistance or safety-critical decisions.
When you open an external website or use another provider’s service, its applicable terms and policies may apply. Cityscribe does not control those independent services. This section does not exclude responsibilities that applicable law places on Cityscribe.
You can report inaccurate place information through the available reporting tools or contact support@cityscribe.com. Corrections may depend on review or on the source provider.
6. USER CONTENT AND THE RIGHTS YOU GRANT
6.1 Your ownership and responsibilities
“User Content” means information and material you submit through the Services, including list names, descriptions, covers, saved-place notes, profile information, and photos. You retain ownership of your User Content as between you and Cityscribe.
Submit only content you have the rights and permissions to share. Your content must comply with applicable law, these Terms, and the privacy, publicity, intellectual-property, and other rights of others. Approval by Cityscribe does not establish that you own the content or have every permission required to use it.
6.2 Permission to operate the Services
You grant Cityscribe a worldwide, nonexclusive, royalty-free license to host, store, reproduce, technically adapt, display, and distribute your User Content as reasonably necessary to provide, maintain, secure, and support the Services, apply your sharing choices, and investigate reports or enforce these Terms. Technical adaptations include resizing, compressing, and formatting images for display.
We may authorize our operational providers to perform these activities on our behalf. We may transfer this license as part of a transfer of the relevant business, subject to its existing scope and your applicable rights. Private content is not licensed for public display or marketing merely because you submit it. Our processing of personal information is also subject to the Privacy Policy and applicable law.
6.3 Public content and promotion
For User Content you choose to make public, the license also permits us to display and reproduce that content in materials promoting Cityscribe, such as our website and promotional materials. This permission is limited to promoting Cityscribe and does not transfer ownership of your content or permit us to claim that you endorse an unrelated product. It does not apply to private content.
If you change content to private through an available control, permission for new promotional use under this section ends. We will remove that content from promotional materials we control when reasonably practicable, but cannot recall copies already independently distributed or retained by others. The image-delivery limitations described in Section 7 still apply. Approved public place photos are subject to the applicable Photo Submission Terms and any removal agreement made under them.
6.4 When these permissions end
Except for approved public place photos covered by the continuing license described below, the license ends when you delete the relevant content or your account. Limited copies may remain for backup, security, dispute resolution, or legal requirements as described in the Privacy Policy. Those limited retention purposes do not authorize continued public display or new promotional use of content whose license has ended. Copies made independently by others are outside our control.
If you submit a place photo for public sharing under Photo Submission Terms that expressly provide for continued use after deletion, and we approve it, the applicable photo license can continue after account deletion. The scope and duration of that permission are set out in the Photo Submission Terms accepted for that submission. Previously submitted content is not automatically moved onto a broader license because these Terms are updated. Mandatory privacy, consumer, copyright, and other legal rights continue to apply.
7. PRIVACY AND VISIBILITY
Our Privacy Policy explains how we process personal information, including analytics, diagnostics, location, retention, and your choices. It is available at https://www.cityscribe.com/privacy-policy. Agreement to these Terms does not replace any separate consent required by privacy law.
Public lists can expose their names, descriptions, covers, saved places, and associated notes to other users. Notes on a public list are not private notes. New lists, including the initial Recents list, are currently public by default. Review each list’s setting before adding information you do not want others to see.
Private-list access in the App is restricted to the owner, but Cityscribe and its operational providers still process the content to provide the Services. List cover images currently have separate image-delivery behavior: making a list private does not make its cover image private, and a person who obtains its image link may be able to view the cover. Do not put sensitive information in a list cover. A private list does not make your profile or all account activity private.
Place photos have separate visibility and credit choices at submission. Public place photos are reviewed before public display. Choosing not to show photo credit does not make the photo private or guarantee anonymity. The Photo Submission Terms explain these choices and the retention of approved public contributions.
Others may copy or share public content outside Cityscribe. Changing visibility or deleting content cannot recall copies already made by others.
8. COMMUNITY STANDARDS
You must not use the Services to:
• Submit illegal, fraudulent, defamatory, threatening, harassing, hateful, discriminatory, sexually exploitative, or obscene content, or content encouraging violence or self-harm.
• Infringe another person’s intellectual-property, privacy, publicity, or other rights, including by exposing private information without an appropriate basis.
• Impersonate others, misrepresent your affiliation, submit knowingly false reports, or manipulate social or moderation features.
• Gain unauthorized access to accounts or systems; distribute malware; disrupt the Services; evade legitimate access restrictions; or abuse the APIs.
• Harvest personal information, scrape or redistribute content without authorization, or use automated access in a way that interferes with the Services or violates applicable rights.
• Send spam or use the Services for unauthorized commercial solicitation.
These restrictions do not prohibit honest criticism, lawful consumer reviews, or activities that applicable law gives you a right to undertake notwithstanding a contractual restriction.
9. REPORTING AND MODERATION
You can report users, places, lists, and photos through the available in-app tools, block users through their profiles, and view or unblock blocked users in Settings. You can also contact support@cityscribe.com. Provide enough detail to identify the issue and do not submit abusive or deliberately misleading reports.
We review public photo submissions before public display and may review other content or accounts in response to reports, legal notices, or safety and integrity concerns. Possible actions include rejecting or removing content, restricting visibility or features, warning a user, or suspending or terminating an account.
We may take these actions for violations of these Terms or applicable law, to address credible safety or security risks, to protect the rights of others, or when content cannot lawfully remain available. We aim to act proportionately to the circumstances. Where required by law, and otherwise where reasonably appropriate, we will provide notice, an explanation, and information about available review or appeal rights. We may act before giving notice where needed for urgent safety or security, to prevent abuse or interference with an investigation, or where law restricts notice, subject to applicable legal requirements.
If you believe a moderation decision is mistaken, contact support@cityscribe.com with the relevant account or content details and your reasons. We will consider requests for review and honor any applicable legal complaint or appeal requirements. We do not guarantee that every submission will be accepted or that review will identify every problem. For immediate danger, contact local emergency services.
10. PLACE-PHOTO SUBMISSIONS
Place-photo submissions are also governed by the Photo Submission Terms available at https://www.cityscribe.com/photo-submission-terms. Where those terms conflict with these Terms on a photo-specific matter, the applicable Photo Submission Terms control, subject to mandatory law.
When you submit a public place photo under Photo Submission Terms that provide for continued use and we approve it, the photo becomes a continuing contribution to the place’s photo collection. For those submissions, approved public photos can remain after account deletion, with displayed account attribution removed. Approval does not transfer copyright to Cityscribe, and removing attribution does not necessarily make a photo anonymous.
Use the available deletion controls for private photos and unapproved public photos, subject to the applicable deletion and retention provisions. Controls may be unavailable while a submission is queued or uploading; contact support for assistance. Approved public photos cannot currently be deleted through the App. Contact support@cityscribe.com to request removal or exercise applicable legal rights.
The terms accepted when a photo was submitted determine the applicable license. This section does not retroactively replace earlier removal promises or expand rights in earlier submissions without the agreement required for that change.
11. COPYRIGHT COMPLAINTS
If you believe content infringes your copyright, contact support@cityscribe.com with the subject “Copyright complaint.” Identify the copyrighted work, the allegedly infringing content and where it appears, your contact details, and the basis for your claim. Include any signature, statements, and other information required for a notice under applicable law.
We may remove or restrict disputed content and request information needed to assess the complaint. We will follow applicable notice, counter-notice, and restoration requirements where they apply. We may terminate accounts of repeat infringers in appropriate circumstances. Submit complaints in good faith and do not misrepresent ownership or infringement.
12. APP STORE AND SOFTWARE LICENSE
Your license to use the App is governed by the end-user license agreement applicable to your download. If no custom license agreement applies, Apple’s Standard Licensed Application End User License Agreement applies. These Terms also govern your use of Cityscribe’s services. Nothing in these Terms limits rights or obligations under the applicable software license, Apple’s applicable usage rules, or mandatory law.
These Terms are between you and Cityscribe, not Apple. Cityscribe is responsible for its Services and the support it is required to provide. Apple has no obligation to provide maintenance or support for Cityscribe. Any allocation of warranty, refund, or other responsibilities remains subject to the applicable software license and law. Apple and its subsidiaries are third-party beneficiaries of the Apple-related provisions of these Terms and may enforce those provisions to the extent applicable.
13. STOPPING USE, ACCOUNT DELETION, AND TERMINATION
You may stop using the Services at any time. To request account deletion, open Settings → Account Settings → Delete Account, or contact support@cityscribe.com if you cannot access your account. Uninstalling the App does not delete your account.
We may restrict or end access for the reasons described in Section 9, where necessary to comply with law, or if we discontinue the Services as described in Section 2. We will provide notice, explanations, and opportunities to retrieve content or exercise remedies where required by law, and otherwise where reasonably appropriate.
Account deletion and termination do not necessarily remove every record immediately. The Privacy Policy describes retention for reports, logs, backups, providers, and other applicable purposes. Approved public photo contributions may remain only to the extent permitted by the license applicable to them and mandatory law. Do not assume that all contributions or copies disappear when an account is deleted.
Provisions that need to continue to give effect to accrued rights or obligations survive termination to the extent relevant, including applicable content licenses, dispute provisions, and lawful limitations of liability. Survival does not create new rights to content beyond the license you actually granted or restrict rights that cannot be waived.
14. SERVICE WARRANTIES AND CONSUMER RIGHTS
Subject to your mandatory legal rights, the Services are provided on an “as is” and “as available” basis. We do not promise uninterrupted or error-free operation, or that every place listing, recommendation, or user submission is accurate or suitable for your needs. To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and noninfringement.
Nothing in these Terms excludes or restricts statutory guarantees, required standards of care, or remedies that cannot lawfully be excluded. Where applicable consumer law provides rights concerning digital services or content, including repair, correction, termination, refunds, or compensation, those rights remain available.
15. LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, willful misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. These Terms do not remove mandatory remedies for loss of or damage to your data.
Subject to those protections and to the extent permitted by applicable law, Cityscribe is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of business profits or business opportunities, arising from use of or inability to use the Services.
Where a monetary limit is legally permitted, Cityscribe’s total liability for claims relating to the Services will not exceed the greater of US $100 or the amount you paid to Cityscribe for the Services in the 12 months before the event giving rise to the claim. This limit does not apply to the liabilities and mandatory remedies preserved above. If a limitation is not permitted in your circumstances, the applicable legal rule governs instead.
16. THIRD-PARTY CLAIMS ARISING FROM MISCONDUCT
To the extent permitted by applicable law, you agree to reimburse Cityscribe for reasonable losses, damages, and legal costs arising from a third-party claim to the extent caused by your unlawful User Content or your intentional or negligent breach of these Terms. This obligation does not apply merely because you lawfully use the Services, does not cover losses caused by Cityscribe’s own wrongdoing, and does not reduce consumer rights that cannot be waived.
We will notify you promptly of a claim for which reimbursement is sought and provide a reasonable opportunity to participate in its defense. We will not agree to a settlement that imposes an admission, nonmonetary obligation, or payment obligation on you without your consent, which must not be unreasonably withheld. Any recovery is limited to reasonable amounts attributable to the conduct covered by this section.
17. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of Nevada, United States, subject to mandatory laws that apply to you. If you are a consumer, this choice does not deprive you of protections provided by laws that cannot be excluded in the country where you habitually reside.
Except where applicable law gives you a right to bring or defend proceedings elsewhere, disputes concerning these Terms or the Services will be brought in the state or federal courts located in Las Vegas, Nevada. Nothing in this section restricts a consumer’s mandatory right to use a competent local court or contact a regulator or other public authority.
You may contact support@cityscribe.com to try to resolve a concern, but doing so is not a condition that limits any legal right or deadline.
