These Terms of Service ("Terms") are a legal agreement between you and Cityscribe ("Cityscribe," "we," "us," or "our") and govern your access to and use of the Cityscribe mobile application for iOS and iPadOS (the "App"), our website at cityscribe.com, and any related services (collectively, the "Services"). By creating an account, downloading, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Services. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Changes to the Services or Terms
We may update the Services or these Terms from time to time. If we make material changes, we will provide notice (for example, by updating the “Last updated” date, in-app notice, or on our website). By continuing to use the Services after changes take effect, you agree to the updated Terms.
3. Your Account and Security
To use certain features (including following other users or creating lists), you may need to create an account.
You agree to:
• Provide accurate and complete information
• Keep your login credentials secure
• Promptly notify us if you suspect unauthorized accessYou are responsible for all activity that occurs under your account.
4. What Cityscribe Does
Cityscribe lets you:
• Search for and view information about places around the world
• Save places to customizable lists ("Lists")
• Follow other users and view their public Lists and content
• Upload or submit photos and other content where availableThe Services may not be available in all countries or regions. We may restrict access in certain jurisdictions, including where prohibited by law.
5. Place Data and Third‑Party Content
Cityscribe displays place information (such as names, categories, locations, photos, ratings, or other details) sourced from third parties, including Foursquare, Apple, and Tripadvisor ("Third‑Party Content").
You understand and agree that:
• Third‑Party Content is provided for informational purposes only and may be inaccurate, incomplete, outdated, or removed
• We do not endorse and are not responsible for Third‑Party Content, including the availability, quality, safety, or legality of any place
• Your use of Third‑Party Content may be subject to the applicable third parties’ terms and policiesIf you believe a place listing or details are incorrect, you can contact us, and we may (but are not required to) investigate or update how content appears in the App.
6. User Content (Lists, Photos, Notes, and Other Submissions)
The Services may allow you to create, post, upload, submit, or share content, such as Lists, list titles/descriptions, notes, profile information, and photographs (collectively, "User Content").
6.1 Ownership
You retain ownership of your User Content as between you and Cityscribe.
6.2 License You Grant to Cityscribe
To operate and improve the Services, you grant Cityscribe a worldwide, non‑exclusive, royalty‑free, sublicensable, and transferable license to host, store, reproduce, modify (e.g., resize/compress), display, distribute, and otherwise use your User Content:
• to provide and maintain the Services (for example, showing a public List to your followers), and
• for safety, integrity, and enforcement (for example, investigating reports), and
• for marketing and promotion, but only for User Content you choose to make public.This license continues until you delete the relevant User Content or delete your account, except that copies may remain for a limited time in backups or as required by law.
6.3 Your Responsibilities
You represent and warrant that:
• You have all rights needed to submit your User Content
• Your User Content does not violate any law or any third‑party rights (including privacy, publicity, copyright, or trademark)
• Your User Content complies with these Terms7. Privacy and Visibility Controls
We take privacy seriously.
7.1 Private vs Public Content
Certain features allow you to set Lists and/or photos as Public or Private.
• Private Lists and content are intended to be visible only to you in the App.
• Public Lists and content may be visible to other users, including people who follow you, and may appear across the Services.Important: No system can guarantee complete privacy. For example, others may capture screenshots or share information outside the App.
7.2 Privacy Policy
Our data practices are described in our Privacy Policy, which is incorporated by reference into these Terms.
8. Community Standards and Prohibited Conduct
You agree not to misuse the Services. You may not:
• Post or share content that is illegal, fraudulent, defamatory, harassing, hateful, discriminatory, or sexually exploitative
• Post or share obscene content or content that encourages violence or self-harm
• Post content you do not have rights to use
• Impersonate others or misrepresent your affiliation
• Attempt to gain unauthorized access to accounts or systems
• Interfere with or disrupt the Services (including introducing malware, scraping beyond ordinary personal use, or abusing APIs)
• Use the Services for commercial solicitation or spam without our written permission9. Reporting and Moderation
Cityscribe may offer in‑app tools to report Lists, photos, or other content that may be inappropriate, offensive, illegal, or otherwise in violation of these Terms.
We reserve the right to review, remove, restrict, or disable access to any content or account at any time, with or without notice, including to:
• Enforce these Terms
• Protect users and the public
• Maintain the integrity of the ServicesWe may also suspend or terminate accounts for repeated violations or serious misconduct.
10. Photo Submissions
If you upload or submit photos, you agree to comply with these Terms and any supplemental terms we provide for photo submissions ("Photo Submission Terms"). If there is a conflict between these Terms and the Photo Submission Terms, the Photo Submission Terms will control for photo-related matters.
11. Copyright and DMCA
If you believe content on Cityscribe infringes your copyright, please contact our designated agent:

Please include sufficient information for us to investigate, consistent with the requirements of the U.S. Digital Millennium Copyright Act (DMCA) or your local equivalent.
12. App Store / Apple Terms
If you obtained the App through the Apple App Store:
• These Terms are between you and Cityscribe, not Apple.
• Apple has no obligation to provide maintenance or support for the App.
• To the maximum extent permitted by law, Apple is not responsible for any claims relating to the App.
• Apple and Apple’s subsidiaries are third‑party beneficiaries of these Terms and may enforce them against you.13. Termination
You may stop using the Services at any time. We may suspend or terminate your access to the Services, or delete your account, if:
• You violate these Terms
• We believe your use creates risk or legal exposure for Cityscribe or others
• We discontinue all or part of the Services14. Disclaimers
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CITYSCRIBE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON‑INFRINGEMENT, AND THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR‑FREE.
Cityscribe is not an emergency service. Do not rely on the Services for safety‑critical decisions.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CITYSCRIBE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES.
IN NO EVENT WILL CITYSCRIBE’S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE GREATER OF (A) $100 USD OR (B) THE AMOUNT YOU PAID TO CITYSCRIBE FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
16. Indemnification
You agree to indemnify and hold harmless Cityscribe and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your User Content, or your violation of these Terms.
17. Governing Law
These Terms are governed by the laws of Nevada, United States, without regard to conflict of law principles. You agree that any dispute arising out of or relating to these Terms or the Services will be brought in the state or federal courts located in Las Vegas, Nevada, and you consent to their jurisdiction.
