These Photo Submission Terms apply when you submit photos of places through Cityscribe. They supplement our Terms of Service and should be read with our Privacy Policy. Profile images and list covers are governed by the general Terms of Service and Privacy Policy rather than the continuing public-contribution license in this document.
These terms apply to submissions made after you agree to this version. Earlier submissions remain subject to the terms applicable when submitted unless you separately agree to a change. Updating this page does not automatically expand Cityscribe’s rights in earlier photos.
1. ELIGIBILITY AND PERMISSION TO SUBMIT
You must meet the eligibility requirements in our Terms of Service, including the baseline minimum age of 13 and any higher age, contractual-capacity, or parental-authorization requirements that apply to you.
Submit only photos you own or have the rights and permissions to submit under these terms. Photos must respect other people’s privacy, publicity, intellectual-property, and other rights. Do not upload unlawful content or material prohibited by our community standards. You are responsible for your submissions; Cityscribe’s approval does not establish that you have the required rights.
2. PUBLIC OR PRIVATE SUBMISSION
When submitting a photo, you choose whether it is public or private and whether to show credit. The current submission form initially selects public sharing and credit, so review those choices before submitting.
Private place photos are available to you through the App and are processed by Cityscribe and its operational providers to store, deliver, secure, and support the feature. A private place-photo choice is separate from the visibility of a list containing that place.
A photo submitted for public sharing is reviewed before public display. If approved, it may appear on the relevant place page and elsewhere in the Services. People who view public photos may copy or share them outside Cityscribe.
3. YOUR OWNERSHIP AND OUR OPERATIONAL LICENSE
You retain ownership of your photos. Submitting a photo or having it approved does not transfer copyright to Cityscribe.
For every submission, you grant Cityscribe a worldwide, nonexclusive, royalty-free license to host, store, reproduce, technically adapt, and deliver the photo as necessary to process the submission, provide the feature according to your visibility choice, and protect the Services. This includes creating resized or compressed versions and reviewing public submissions. Operational providers may perform these activities on our behalf.
For private photos and public submissions that are not approved, this operational license ends when the photo or account is deleted, except for limited retention needed for backups, security, disputes, or legal requirements as described in the Privacy Policy. Those exceptions do not authorize public display or marketing of private or unapproved photos.
4. CONTINUING LICENSE FOR APPROVED PUBLIC PHOTOS
If you select public sharing and Cityscribe approves the photo, you grant Cityscribe a continuing, worldwide, nonexclusive, royalty-free license to host, store, reproduce, technically adapt, publicly display, and distribute it as part of Cityscribe’s place-photo collection and related Services. This license also permits use in materials promoting Cityscribe, including its website and promotional materials. It does not permit us to claim that you endorse an unrelated product.
We may authorize operational providers and distribution providers to exercise these rights only as needed for those uses. The license may transfer with the relevant Cityscribe business, subject to its existing limits.
The license for an approved public photo survives account deletion and continues for as long as Cityscribe uses the photo for the purposes permitted above. Ordinary account deletion does not withdraw that permission. Approval does not require Cityscribe to keep displaying the photo, and we may stop using or remove it.
This continuing license is subject to mandatory privacy, consumer, copyright, and other legal rights. It does not override an applicable right to erasure or a legal restriction on continued use following termination. Contact support@cityscribe.com to request removal or exercise those rights. We will assess requests under the applicable terms and law; this section does not make every removal request automatically ineffective.
If we agree to withdraw a photo from public use or change it to private, the continuing license no longer permits the uses withdrawn under that agreement. We will stop the relevant public display and new promotional use, and remove the photo from promotional materials we control, within the agreed timeframe or any shorter deadline required by law. Limited retention described in the Privacy Policy and copies made independently by others may remain. This does not authorize new public or promotional use after the relevant permission has ended.
5. DELETION AND ACCOUNT CLOSURE
Use the available deletion controls for private photos and unapproved public photos. Controls may be unavailable while a submission is queued or uploading; contact support@cityscribe.com for assistance. Account deletion removes the associated private and unapproved photo records through the deletion process, subject to the retention and local-storage limitations explained in the Privacy Policy. Removal may take time to reach cached copies, backups, and other systems; we do not promise immediate erasure of every stored copy.
Approved public photos cannot currently be deleted through the App. For photos covered by Section 4, they may remain after your account is deleted. Displayed account attribution is removed on account deletion, but the photo itself and associated internal information may still identify you or another person. Removal of credit is not a guarantee of anonymization.
You may contact support@cityscribe.com about a retained photo, an infringement, a privacy concern, or another removal request. Copies made independently by other people are outside Cityscribe’s control.
6. PHOTO CREDIT
You choose at submission whether credit should be shown with a public photo. If credit is enabled, the photo may be displayed with your Cityscribe profile information. Choosing not to show credit hides the displayed credit; it does not make the photo private or guarantee that the uploader cannot be identified from the image or associated information.
The current App does not provide controls to change an existing submission’s credit or visibility after upload. Contact support@cityscribe.com if you need help with an existing submission.
7. MODERATION AND REPORTS
We may reject public submissions, remove or restrict photos, or take account action for violations of the Terms of Service or applicable law, credible safety or security concerns, infringement, misleading place associations, or other legitimate content-integrity reasons. We aim to act proportionately and provide notice, reasons, and review opportunities where required by law, and otherwise where reasonably appropriate. Urgent safety, security, or legal circumstances may require action before notice, subject to applicable legal requirements.
Use the in-app report feature or contact support@cityscribe.com to report a photo. If you believe a decision was mistaken, identify the photo and explain your concern when contacting us. Moderation does not guarantee that every approved photo is accurate, lawful, or suitable for every viewer.
8. PRIVACY AND TECHNICAL PROCESSING
We may resize, compress, reformat, or create variants of photos for display and delivery. Our current place-photo import flow prepares a new image without the source file’s embedded GPS metadata, but the photo itself and the place associated with it may still reveal a location or identify someone.
The Privacy Policy explains the information processed with submissions, service providers, security, retention, and privacy rights. Do not treat a photo submission as consent to unrelated processing that requires separate consent.
9. RELATIONSHIP TO THE TERMS OF SERVICE
The Terms of Service govern other matters, including community standards, copyright complaints, account restrictions, warranties, liability, and disputes. If there is a conflict on a photo-specific matter, these Photo Submission Terms control, subject to mandatory law. Neither document takes away rights that cannot lawfully be waived.
Material changes to these terms will be notified as described in the Terms of Service, and any further agreement required by law will be obtained. Earlier submissions remain subject to the opening paragraph’s rule on changes to existing rights.
